A judicial order for the participation of minors in public events is required. While applying for the judicial order, the applicant should present the child or adolescent's identification documents, and give the basic characteristics of the event, such as date, place, schedule and description of the presentation.
Also the legal guardian, parents of the child or the adolescent must expressly authorize its participation in the event.
The producer of the audiovisual work should, necessarily, observe two factors: the phonomechanical recording reproduction rights, and the musical or literary-musical work synchronization right.
This means that the producer should apply for two authorizations when licensing the music. One to the holder of the phonomechanical rights who should grant authorization for reproduction of such phonogram, and the other one to the author or holder of the copyrights who should be asked to grant the inclusion of the musical or literary-musical work in an audiovisual work.
Despite the natural curiosity that permeates the life of public persons, Brazilian legislation does not allow publication of a non-authorized biography. In Brazil, personality rights are protected by the legislation and, in case of non-authorized disclosure, breach or injury threat of name, image or biographic data, the biographe (or his/her heirs) may request the forbidding of the biography's disclosure or commercialization, without prejudice of the due reparation for moral or material damages.
The writer and/or publisher interested in publishing a biography should contact the person targeted, or his/her heirs), in order to get the needed authorization.
